Terms and Conditions

1. Return & Refund Policy

All of our products are thoroughly tested both functionally and physically prior to shipment. We can only guarantee the authenticity and therefore only offer returns and repairs for products purchased directly through our website. Products purchased by unauthorized third party sellers are not subject to returns and repairs by ModalAI, Inc. For a copy of your products test records, please request on the forum with the serial number.

Repair and Diagnostic Fee

If you have an item that is malfunctioning, we can offer diagnostic and repair services. Our fee for a diagnostic evaluation is $150. Each unit typically takes around 2 weeks to be inspected after being received. If the unit is deemed repairable, we can repair the broken unit for a repair fee which typically takes 2-4 weeks after diagnostics have been completed.

In the case the customer damaged the unit, and it is unrepairable, the diagnostic fee is applied as a discount for replacement units.

Please be sure to exercise proper handling techniques and that you double check all connectors before installation to avoid damage.

If you return an item to ModalAI for replacement, and that item is verified as either counterfeit or a product not manufactured by ModalAI, you will be notified via e-mail with instructions for retrieving your item. You will have a maximum of 3 business days to request that the item be shipped back to you at your cost.

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are nonrefundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

2. Use at Your Own Risk Disclosure

This website shares our ideas and experiences only. We have built our own robot perception and communications systems and do our best to support our customers with what we've learned and the products we recommend. Therefore, any information on this website is not intended to amount to advice on which you should rely. None of the authors, contributors, administrators, or anyone else connected with ModalAI, Inc. and this website in any way whatsoever, can be responsible for your use of the information contained in or linked from these web pages. Be sure to do your own research and obtain professional advice as needed.

3. Terms and Conditions

WARNING

By installing propellers and battery you are assuming all liability in operation of a drone or flight controller purchased from ModalAI, Inc.

Unmanned Aerial Systems (drones) are sophisticated, and can be dangerous. Please use caution when using this or any other drone. Do not fly in close proximity to people and wear proper eye protection. Obey local laws and regulations.

LIMITED WARRANTY - ModalAI, Inc. Products

Who is a "Customer" for purposes of this limited warranty?

If you have purchased a product(s) directly from ModalAI, Inc., you are considered a "Customer" for purposes of coverage under this limited warranty.

Limited Warranty

ModalAI, Inc. warrants that the product(s) will be free from defects in material or workmanship on shipment for a period of 30 days from the date of ModalAI, Inc.’s shipment of the product(s) to you, the Customer. In the event of a defect covered by this limited warranty, ModalAI will, at its option and free of charge to Customer, repair, replace or refund the purchase price paid. MODALAI, INC. MAKES NO OTHER EXPRESS WARRANTIES EXCEPT AS PROVIDED HEREIN, AND ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE SHALL ONLY BE IN EFFECT DURING THE 30 DAY WARRANTY PERIOD PROVIDED HEREUNDER. MODALAI, INC'S LIABILITY ON ANY WARRANTY CLAIM SHALL BE LIMITED TO THE ACTUAL PURCHASE PRICE PAID. MODALAI, INC. SHALL NOT BE RESPONSIBLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, REVENUES, SALES, BUSINESS, GOODWILL OR USE.

What does this limited warranty NOT cover?

ModalAI, Inc. has no obligation to repair, replace, or provide refunds in the following Instances:

If Customer purchased ModalAI, Inc. products from a third party. We can only guarantee proper testing and function if Customer purchases directly through our website;
If Customer did not follow proper electronics handling practices;
If the alleged defect arises because Customer has altered or repaired the product(s) without the prior written consent or authorization of ModalAI, Inc.;
If Customer did not follow any applicable instructions for proper storage, usage, or maintenance of the product(s);
If Customer has failed to notify ModalAI, Inc. of any defect where the defect should have been reasonably apparent on inspection; or
If Customer fails to notify ModalAI, Inc. of the defect within 30 days of ModalAI, Inc. shipment of product(s) to Customer.

This limited warranty does not cover the cost of shipping the defective product(s) to ModalAI, Inc. for repair, or the cost of shipping the repaired or replacement product(s) to you.

Unauthorized Reseller Warning

ModalAI is firmly committed to providing our customers with best in class, reliable products. Our policy is to honor product warranties and to perform services only on products purchased directly from the ModalAI website and only accompanied by a receipt or proof of purchase. If you purchase a ModalAI product from an unauthorized dealer or if the original factory serial number has been removed, defaced or altered, your ModalAI warranty will not be valid.

Unfortunately, there are some websites and dealers who claim to be authorized ModalAI resellers but are not. Products sold on these websites or from these dealers do not carry a warranty from ModalAI. When you purchase products from an unauthorized website or dealer you are taking a risk, because these products may be counterfeit, used, defective, or may not be designed for use in your country. Please protect yourself and your ModalAI product by ensuring that you only purchase ModalAI products from our website.

If you purchased a counterfeit product with a credit card, you may wish to contact your credit card company and dispute the charge.

We value and respect your privacy, and are committed to protecting it under this Privacy Policy. This Privacy Policy describes the types of information ModalAI Inc. (“Company”, “we,” “us” or “our”) may collect from you (“User,” “you,” or “your”) or that you may provide through communications with us or other third parties, or when you use or access the website www.modalai.com (the “Website”) (collectively the “Services”). Please read this Privacy Policy carefully to understand our policies and practices for collecting, using, maintaining, protecting and disclosing your information.

By accessing or using the Services, you agree to this Privacy Policy, including the collection, use and sharing of your information as described herein. If you do not agree with our Privacy Policy, you must not access or use the Services. Information Deletion: If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Services users.

We, or through third-party service providers, have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. Unfortunately, the transmission of information via the Internet is not completely secure.
